Acceptable Use Policy for One by Lessen – Internal Portal

This Acceptable Use Policy (“AUP”) for One by Lessen – Internal Portal(“One”) is effective as of December 14, 2023.

You are being granted access One as a result of your employment or other agreement with Lessen LLC. and its affiliates (“Lessen” or “We”). This AUP applies to your use of One, and the services and applications accessible through it. Should you violate any of the terms of this AUP, we may suspend your access to One or take any other appropriate action. Nothing in this AUP shall alter or amend the terms of your employment or other arrangement with Lessen and this AUP in addition to any applicable policy manuals or other agreements with Lessen.

Registration and Access to One

Your right to access One is solely for the benefit of Lessen and not for any personal use.

The information you supply during the registration process, and at other points where such information may be required in the course of using One, must be accurate and complete and you may not register, or attempt to enter One, under the name of another person or entity.

You are responsible for maintaining the confidentiality of your Login ID and password (“Access Credentials”), and for all activities that occur under your Access Credentials. If you discover or suspect any unauthorized use of your Access Credentials or any other breach of security of your Access Credentials, you must immediately notify Lessen at security@lessen.com.

You may not access or attempt to access any password-protected portions of One without authorized Access Credentials or through any means other than by utilizing your authorized Access Credentials.

You may not interfere, in any way, with others’ use of or access to One.

Even though we strive to protect the information provided to Lessen, you acknowledge that Lessen cannot guarantee the security of data transmitted over the Internet. As such, we cannot ensure or be held responsible for the security of any information you transmit to or receive from us via the Internet beyond our commitment to employ appropriate security protocols.

Lessen Materials

One includes various types of information, materials and content from Lessen and others (“Lessen Materials”). You acknowledge that Lessen (or its licensors) owns all rights to Lessen Materials, and Lessen Materials are protected by copyright, trademark, trade secret, and other intellectual property laws.

You may download, view, copy, and print Lessen Materials (i) solely for the benefit of Lessen and (ii) provided that neither the Lessen Materials, nor any proprietary notices or disclaimers therein, are modified or altered, except as otherwise specifically permitted by Lessen in writing.

You may not, in any way, tamper with One or decompile, reverse engineer, disassemble, or unlawfully use One, nor may you assist any person or entity in any way in such activities.

Information You Submit 

You acknowledge that you are responsible for the information, data, and other content (collectively, “User Content”) you upload or transmit to One, and that you, and not Lessen, will bear full responsibility for each item of User Content, including its legality, reliability, appropriateness, originality, and copyright.

There are certain restrictions relating to the posting, uploading, or transmitting of User Content. Specifically, you may not:

Upload or transmit any information that infringes or otherwise violates any copyright, patent, trademark, trade secret, or other proprietary right of any third party.

Upload or transmit any information that is defamatory, libelous, expresses hate, is unlawfully threatening, or harasses or advocates the harassment of another person.

Upload or transmit any information that is pornographic, exploitative of a minor, or obscene.

Upload or transmit any information that violates any legal rights of others or contains any material that could give rise to any civil or criminal liability under applicable laws and regulations.

Upload software or programs contaminated with a computer virus, worm, Trojan horse, or other contaminating or destructive feature.

Upload or transmit any information that by its disclosure violates any agreement or other obligation to which you are bound.

By uploading or transmitting any User Content to One, you are hereby assigning to Lessen all of your right, title, and interest (including intellectual property rights) in and to such User Content. Accordingly, Lessen will have full rights to use, display, license, and distribute such User Content. Any copies of User Content will be held by you subject to your obligations of confidentiality as set forth in the Agreement or other agreement between you and Lessen, and you may not use, reproduce, display, distribute, and otherwise disclose to such User Content to third parties for any purpose.

By uploading or transmitting any User Content to One, you represent and warrant that:

You own or control all rights in and to the User Content and have the right to assign ownership of the User Content as set forth above.

All of your User Content will comply with this AUP.

You understand and acknowledge that you are responsible for any User Content you submit or contribute, and you, not Lessen, have full responsibility for such content, including its legality, reliability, accuracy, and appropriateness.

We are not responsible, or liable to any third party, for the content or accuracy of any User Content uploaded or transmitted by you or any other user of One.

Confidentiality

Through access to and use of One, you will be privy to confidential and proprietary information of Lessen and its customers (“Confidential Information”). This Confidential Information includes (but is not limited to) the Lessen Materials, any and all information regarding Lessen customers, the User Content and information regarding One, including its features, specifications and all intellectual property relating thereto. You are required to maintain the Confidential Information in strict confidence, not disclose any such Confidential Information to third parties and not to use any such Confidential Information other than in the performance of your work for Lessen. Your continued access and use of One is conditioned upon your adherence to the foregoing.

Minors

One is not intended for children under the age of eighteen and should not be used by anyone under eighteen.

Changes to this Acceptable User Policy

We may revise this AUP from time to time. If we make a change to this AUP that, in our sole discretion, is material, we will notify you that the policy has changed and provide you with an opportunity to review. By continuing to access or use the Services after those changes become effective, you will be bound by the revised AUP.
